Rapid response when labor rights matter

We represent parties in USMCA's innovative Facility-Specific Rapid Response Labor Mechanism. From initial reviews to panel proceedings, we provide strategic counsel to both complainants and respondents in labor rights disputes, including in light of Mexican labour law.

The USMCA Rapid Response Labor Mechanism (RRLM) is a groundbreaking enforcement tool that allows expedited action against specific facilities violating workers' rights to free association and collective bargaining. This first-of-its-kind mechanism provides for facility-level enforcement with potential trade consequences.

Our practice covers the complete spectrum of RRLM proceedings. For governments and labor unions initiating reviews, we provide strategic guidance on case development and evidence presentation. For facilities under review, we develop effective compliance strategies and defend against unjustified claims. Our work encompasses initial case assessment, facility-specific reviews, verification procedures, and panel proceedings.

We bring particular value through our experience representing both complainant and respondent parties under this novel mechanism. This dual perspective enhances our ability to craft effective strategies for each client's specific situation. When remediation becomes necessary, we assist in developing and implementing practical solutions that address compliance concerns while minimizing business disruption.

Our team has had direct participation in USMCA disputes, including in the Mexico - San Martin Mine case, and therefore combines technical expertise with practical knowledge of how RRM panels operate. Whether challenging labor violations or defending against claims, we provide clear, strategic counsel grounded in USMCA law and jurisprudence.
