Strategic counsel in multilateral trade disputes

Our team provides support at all stages of the WTO dispute settlement process

The WTO dispute settlement system is a cornerstone of the multilateral trading system, providing a rules-based mechanism for resolving trade conflicts between WTO members.

Our team provides support in WTO panel, Appellate Body, ad-hoc appeals, and implementation proceedings. We also provide support during the consultations stage and in reaching mutually agreed solutions.

We represent complainants, respondents, and third parties. For governments initiating or responding to complaints, we provide strategic guidance on case development, evidence gathering, litigation architecture, and argument presentation. For respondents, in particular, we develop comprehensive and vigorous defense strategies and assist in implementing WTO-consistent measures.

Our support includes:

  • Initial assessment of the policy and circumstances at hand
  • Strategic evidence gathering
  • Strategic design of lines of arguments
  • Drafting consultations requests
  • Drafting questions and responding to questions in preparation for consultations
  • Drafting panel requests
  • Drafting panel submissions and gathering accompanying evidence
  • Responses to questions from the panel or other parties during the panel stage
  • Drafting questions to be posed to other parties during the panel phase
  • Advocacy at panel hearings
  • Drafting notices of appeal and notices of other appeal
  • Drafting Appellate Body and ad-hoc appeal submissions
  • Advocacy during Appellate Body and ad-hoc appeal hearings
  • Support during the implementation phase, including implementation strategy and negotiations, as well as DSU Article 21.5 consultations, panel litigation, and appeals
  • Representation in DSU Article 21.3(c) arbitrations to determine the reasonable period of time to implement rulings
  • Representation in DSU Article 22.6 arbitrations to determine the level of nullification or impairment
  • Alternative dispute resolution proceedings
  • Drafting statements for Dispute Settlement Body (DSB) meetings as necessary

Our team combines deep technical knowledge of WTO law with practical experience in multilateral dispute settlement. Our experience working with the WTO Secretariat and assisting dispute settlement panels gives us unique insight into how cases are decided.
